1. Acceptance of Terms

By installing the OpenTrace Chrome extension or using our website at email-tracker-backend-dwqb.vercel.app, you agree to be bound by these Terms of Service. OpenTrace is operated by sole proprietor Syed Saad Ali Askari (trading as OpenTrace). If you do not agree to these terms, please do not use OpenTrace.

2. Description of Service

OpenTrace is a personal productivity service for Gmail. It helps you see when emails you choose to track are opened. The service consists of a Chrome extension and a web dashboard. OpenTrace is not a cold-email, bulk-mail, or unsolicited marketing platform — you send mail through your own Gmail account; we only add open-tracking when you turn it on for a specific send. OpenTrace offers a free tier (limited to 20 tracked emails per month), optional one-time top-ups, and a paid Pro tier (unlimited tracking and dashboard features).

3. Eligibility

You must be at least 13 years of age to use OpenTrace. By using our service, you represent and warrant that you meet this age requirement. OpenTrace is intended for personal and professional productivity use only.

4. Acceptable Use

OpenTrace is for personal and professional productivity only — for example following up on messages you already send to people you know (clients, colleagues, applications). You agree to use OpenTrace only for lawful purposes. You must not use OpenTrace to:

  • Send spam, cold email, or unsolicited bulk / mass marketing email
  • Facilitate unsolicited outbound marketing campaigns
  • Use purchased, scraped, harvested, or rented email lists
  • Harass, stalk, or monitor individuals unlawfully or without a lawful basis
  • Violate any applicable local, national, or international laws or regulations (including anti-spam and privacy laws)
  • Attempt to reverse engineer, hack, or disrupt our service infrastructure
  • Resell or redistribute OpenTrace without our written permission
  • Use automated scripts to artificially inflate open counts

You are solely responsible for how you use open-tracking and for complying with applicable privacy and anti-spam laws. You must only track people you correspond with for your own personal or professional messages — not bulk, unsolicited, or cold email. Accounts may be suspended or terminated for Acceptable Use violations.

5. Free Plan Limitations

The free plan allows tracking of up to 20 emails per calendar month. Once this limit is reached, tracking will be disabled until the following month or until you upgrade to the Pro plan. Open count data and email history remain accessible even after reaching the free limit.

6. Pro Plan & Payments

The Pro plan is available for $5.00 USD per month, or $40.00 USD per year, billed in advance for the selected period. Optional email top-ups are one-time purchases. Payments are processed securely through Paddle (Merchant of Record). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your Pro subscription at any time via Manage Billing and will retain Pro access until the end of your current billing period. For refunds, see our Refund Policy.

7. Account Responsibility

You are responsible for maintaining the security of your account and any activity that occurs under your account. You must notify us immediately at supportopentrace@gmail.com if you suspect unauthorized access to your account.

8. Intellectual Property

All content, features, and functionality of OpenTrace — including but not limited to the extension code, website design, logos, and text — are owned by OpenTrace and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of our service without our express written permission.

9. Disclaimer of Warranties

OpenTrace is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that tracking will work in all email clients. Some email clients block tracking pixels by default, which may prevent accurate open detection.

Open counts and notifications are approximate technical signals. They do not guarantee that a recipient personally read your message. We filter many false opens (including your own views in Gmail when the OpenTrace extension is installed and signed in), but filtering is not perfect — for example when you open mail in a mobile app or browser without the extension. Do not rely on OpenTrace as the sole basis for legal, compliance, or employment decisions.

10. Limitation of Liability

To the fullest extent permitted by law, OpenTrace shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these terms shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to OpenTrace at any time, with or without notice, if we believe you have violated these Terms of Service. You may delete your account anytime from Settings. If you have an active Pro subscription, deleting your account cancels that Paddle subscription and then removes your tracking data. You can also manage billing via support.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes by updating the date at the top of this page. Your continued use of OpenTrace after changes are posted constitutes your acceptance of the revised terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through good-faith negotiation before any formal legal proceedings are initiated.
